Introduction

Please read this carefully before using our site, services, products. This agreement (“Terms and Conditions“, “T&C“, “ToS“) is a legal contract between you (“you”) and Koh Tao Good Time (“Website”, “we”, “us”, “Goodtime Thailand”, “www.goodtimethailand.com”) over your use of our website. Also referred to as “Goodtime Thailand’s deposit, surcharge, refund and cancellation policy” or “Goodtime Adventures’ deposit, refunds & cancellations policy”.

By using this Website you will be bound by these T&C and the Company’s privacy policy (“Privacy Policy“). If you don’t agree to these T&C and/or the Privacy Policy, you must not use this Website.

Your Personal Data

We respect your rights regarding your privacy and information, and we provide this Privacy Policy to help you understand how we collect, use, share, store and disclose information we obtain from or about you when you use the Services.

This Privacy Policy also describes the choices available to you regarding the use of, your access to and how to update and correct your information.

Deposits

At the time of booking full activity payment per person is required to secure a spot, except:

  • 4000THB per person for all courses or for boat charters

 

The balance of payment is due at the point of check in for the activity. Certifications will not be processed until full payment has been received. Any bookings that remain unpaid 24 hours ahead of arrival, without prior agreement from Goodtime, will be cancelled. All insurance balances must be paid at the time insurance is requested. Payments taken by credit or debit card are subject to a 5.5% processing fee.

Cancellation

Goodtime reserve the right to cancel or amend an adventure without prior notice.

Goodtime reserve the right to refuse participation in all or any part of an activity if the participant is believed to be under the influence of alcohol or drugs, or is unfit to participate safely for any other reason. No refunds will be given.

Refunds

Refunds may be available on payments for the following conditions only:

  1. Goodtime is unable to offer either the adventure booked or a suitable alternative (activity or date), for example due to weather conditions or staff illness.
  2. The customer is unable to take part in the booked adventure due to illness or injury, provided Goodtime Adventures is notified 24 hours before the scheduled departure time of the trip. The exception is with private boat charters, which are subject to a 36 hour cancellation period

Insurance cover must be cancelled no later than 24 hours prior to the start date of the purchased policy. Refunds are subject to the processing policy of Indepths.org.

Changes can be confirmed between the hours of 09:00 and 18:00, during regular office opening times.

Non-Refundable Payments

Dive courses cancelled less than 24 hours in advance or any training materials that have been used may be subject to charges for materials issued. In this situation, Goodtime will transfer the associated certification credit to the customer. This credit is valid for up to 12 months from the original date of issue. Dive activities booked where the customer is unable to participate/complete, due to failure to meet the minimum requirements, e.g. swim tests & medical sign off, will be subject to non-refundable deposit fees and pro rata course fees where appropriate.

Pro Rata Course Fees

If a diver is unable to complete the required skills for their course they will be subject to the following refunds:

  • If cancelling before any open ocean training has commenced they will receive a 50% refund.
  • If cancelling after open ocean training has commenced they will be subject to non-refundable course fees.

Bad Weather, Staff Illness/Injury & Equipment Failure

If no part of an adventure is possible and a mutually agreed-upon time to reschedule is not possible, the customer is entitled to a full refund of monies paid, including the deposit.

If up to half an adventure is possible, the customer agrees to pay half price.

If over half the adventure is possible, the customer agrees to pay the full price.

If Goodtime has made the full adventure available but the customer chooses not to participate in any or all parts, the customer is liable for full payment at Goodtime’s discretion.

Equipment Owner Disclaimer

We, the owner confirm that to the best of our knowledge and belief that our equipment is free from any known faults or deficiencies which would affect safe and reliable operation under normal and prudent usage.

Equipment Renter Disclaimer

I assume all and full responsibility for the use any equipment borrowed or rented from Goodtime. I confirm that I will inspect the operation of said equipment. I understand I am obligated to return equipment on the agreed date in the same condition in which it was rented. Furthermore I understand that I am responsible for all items and agree that I am liable for any charges necessary to replace equipment rented to me that becomes damaged or lost. Replacement costs for lost/mistreated/unfairly damaged equipment may include, but are not limited to, the full replacement or repair value of the item.

Personal Belongings Disclaimer

Goodtime accept no responsibility for any loss or damage of any personal items that occurs either at our premises, or during any of our activities, whether on or off site. Bringing personal items to the premises or to any activity is done so entirely at the owner’s risk.

Personal Information Disclaimer

Goodtime will capture and store your data in line with our privacy policy, for administrative and analysis purposes, and may share this with selected third-party partners as needed. Goodtime will not share or sell this information to any other parties unless required by law. Any customers who participate in diving activities will complete additional waivers relating to the activities scheduled; this information will be stored as required by the relevant dive agency’s own policies and regulations. Social media profiles, posts, or photos, you use to tag, like, or comment, on any Goodtime page, profile, or post, may be used to promote Goodtime activities and adventures. Any photos taken of an activity, or event, you are participating in may be used in relation to any Goodtime marketing materials.
